Acceptance of Terms and Conditions

This Agreement is a contract that governs the use of the site and services which are offered by Beyond Teaching, LLC (hereinafter “Gobeyondteaching.com”) at the Gobeyondteaching.com Website (the “Site”), including, but not limited to, accessing, using and/or subscribing to the Site as either a Service Seeker or a Service Provider, as defined below, (collectively, “Site Users”) .  This Agreement contains all of the terms and conditions (the “Terms and Conditions”) between you and Gobeyondteaching.com, its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives, whether or not you register as a Service Seeker or a Service Provider, as defined below. You should carefully review these Terms and Conditions before accessing, using and/or subscribing to the Site.

By accessing, using and/or subscribing to the Site, you represent, warrant, understand and agree: (i) to accept the Terms and Conditions without modification, (ii) to be bound by these Terms and Conditions, (iii) that you understand all Terms and Conditions, and (iv) that you are legally capable of agreeing to the Terms and Conditions.

These Terms and Conditions are subject to change at any time at the sole discretion of Gobeyondteaching.com and any changes are effective immediately upon posting on the Site.  It is your responsibility, to check the Site to see if there are changes to these Terms and Conditions.  Accessing, using and/or subscribing to the Site following the posting of any changes to the Terms and Conditions shall be deemed an irrevocable acceptance by you of any changes to the Terms and Conditions.  

This Agreement is immediately effective when you access, use and/or subscribe to the Site.

If you object to any of the Terms and Conditions, do not access or use the Site or subscribe to the Site.

Gobeyondteaching.com Is A Communications Platform Allowing Service Seekers To Connect with Service Providers

Gobeyondteaching.com is a communications platform allowing individuals seeking childcare services (“Service Seekers”) to connect with individuals seeking to provide childcare services (“Service Providers”).  Gobeyondteaching.com does not, review, screen or censor the information posted on the Site or communications between Service Seekers and Service Providers.  Gobeyondteaching.com is not involved in the transactions between Service Seekers and Service Providers. Gobeyondteaching.com has no control over the quality, timing or legality of jobs offered by Service Seekers or the services provided by Service Providers.  Gobeyondteaching.com makes no representations about the suitability, reliability and/or accuracy of the jobs posted by Service Seekers or the services offered by Service Providers.  It is the responsibility of Site Users to screen and conduct their own investigation of Service Seekers and Service Providers, as the case may be. If any disputes arise between or among Site Users, Site Users are obligated to deal directly with eachother to resolve the disputes.

THE SITE IS PROVIDED ON AN “AS IS” BASIS. 

Disclaimer of Warranties, Guarantees, Liabilities, Hold Harmless, and Indemnification

No Representations, Warranties or Guarantees

Gobeyondteaching.com makes no representations, warranties or guarantees of any kind. Gobeyondteaching.com disclaims all warranties, whether express or implied, with respect to the Site. It is your responsibility to evaluate and investigate any position offered by a Service Seeker, and any services offered by a Service Provider, as the case may be. It is your responsibility to make an independent investigation and evaluation of any Service Seeker or Service Provider, as the case may be. Gobeyondteaching.com is a communications platform only.  Gobeyondteaching.com is not involved in the transactions between Site Users.

 No Liability

You represent, warrant, understand and agree that gobeyondteaching.com, its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives do not have any liability for or control over Site Users, including, but not limited to: (i)  Eligibility Certifications, as defined below, (ii) Teacher Eligibility Certifications, as defined below, (iii) information provided by Service Seekers or Service Providers, (iv)  the content, quality, truth, accuracy, safety or legality of the jobs posted by Service Seekers, (v) the content, quality, truth, accuracy, safety or legality of the resumes posted by Service Providers, (vi) the ability of Service Seekers to offer the jobs posted on the Site, (vii) the ability of Service Seekers to fill the positions posted on the Site and/or meet the qualifications of such positions, (viii) representations made by Service Seekers or Service Providers, (ix) the quality of the services and/or actions provided by Service Providers, (x) the background of Service Seekers or Service Providers, (xi) the legality of Service Seekers or Service Providers, (xii) the actions or omissions of Site Users, Service Seekers or Service Providers (xiii) misstatements and/or misrepresentation of a Service Seeker or Service Provider.

Gobeyondteaching.com, its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives disclaim any liability for any damages, disputes, claims, suits, losses, expenses, causes of action, controversies, settlements, penalties, fines, debts, sums of money, judgments, demands, executions, and the like, of every kind and nature whatsoever, including, but not limited to, reasonable attorney’s fees and costs and other related expenses incurred by Gobeyondteaching.com and/or, its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives in relation to a third party and arising out of or in relation to the Site or in any way connected with the relationships arising out of the Site, any communication, contact or interaction between Site Users, or any act, omission, instruction, advice, and/or services delivered which originated from or arose through the Site or any information submitted, posted or transmitted through the Site or use of the Site in violation of these Terms and Conditions or in violation of any applicable law or regulation.

Hold Harmless and Indemnification

You agree to indemnify and hold harmless gobeyondteaching.com its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives at your sole cost and expense for any damages, disputes, claims, suits, losses, expenses, causes of action, controversies, settlements, penalties, fines,  sums of money, judgments, demands, executions, and the like, of every kind and nature whatsoever, including, but not limited to, reasonable attorney’s fees and costs and other related expenses incurred by Gobeyondteaching.com and/or, its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives in relation to a third party and arising out or in relation to the Site or in any way connected with the relationships arising out of the Site or any communication, contact or interaction between Site Users, or any act, omission, instruction, advice or services delivered which originated from or arose through the Site or any information submitted, posted and/or transmitted through the Site, and or use of the Site in violation of these Terms and Conditions or in violation of any applicable law or regulation.

Gobeyondteaching.com reserves the right, but has no obligation, to assume the defense of any matter governed by this Agreement. You agree to cooperate fully in any matter arising under this Agreement and/or the Site, including, but not limited to any defense. 

Without limitation to the foregoing, you shall not settle any claim, cause or matter arising from or in relation to the Site without timely written notification to and consent in writing from Gobeyondteaching.com.

Removal of Information

Gobeyondteaching.com reserves the right to remove information and material from the Site in its sole discretion. Gobeyondteaching.com reserves its rights under the Communications Decency Act to remove any information and material from the Site. 

Agreement to Report Objectionable or Improper Information or Material or Improper Use of the Site

You hereby agree to report any alleged inappropriate, improper and/or objectionable material or information on the Site or improper, objectionable and/or inappropriate use of the Site immediately via electronic correspondence to support@gobeyondteaching.com.  

Communications Between Site Users

The Site is a platform which allows individuals to communicate through email, resumes, profiles, job listings and other communication means (“Communications”).  You represent, warrant, understand and agree to send and receive Communications that are lawful, relevant and proper to the Site. 

You further agree not to:

1. Harass, threaten stalk, defame or violate the legal rights of Site Users or a third party.
2. Publish, post, upload, distribute or disseminate any profane, defamatory, infringing, obscene or unlawful information or material.
3. Use the Site for a purpose which violates any law or regulation.
4. Publish, post, upload, distribute or disseminate any information, material or data which violates the property rights of a Site User or a third party.
5. Publish, post, upload, distribute or disseminate any information or material which violates the rights of privacy or publicity of Site Users or a third party.
6. Upload corrupted files or files which contain viruses or which may damage the operation of the Site or computer of  Site Users or athird party.
7. Conduct business not related to the Site at or through the Site.
8. Forward surveys, contests, schemes or chain letters.
9. Impersonate another person.
10. Allow another to use your identification to use and or access the Site.
11. Post the same information or material repeatedly.
    

Eligibility Requirements and Certifications

The Site is available only to individuals and companies that can form legally binding contracts under applicable law.  The Site is not designed for and is not made available to minors under the age of eighteen (18) or to anyone who is not legally authorized to work in the United States.

By accessing, using and/or subscribing to the Site, you certify, represent and warrant that you meet and will continue to meet the following conditions for so long as you access, use and/or subscribe to the Site.

1. You are over the age of eighteen (18).
   

2. You are able to enter into and form a legally binding contract.
   

3. You have the authority and capacity to enter into this Agreement.
   

4. You agree to abide by the Terms and Conditions set forth herein.
   

5. You are legally authorized to work within the United States.
   

6. You have never been: (a) arrested, (b) convicted of a crime, (c)arrested for a sexual offense, (d) charged with a sexual offense, (e)  convicted of a sexual offense (f) arrested for an offense involving a minor, (g) charged with an offense involving a minor, (h)convicted of an offense involving a minor; (i) arrested, the subject of a complaint or legal action, charged with, arrested and/or convicted of a sexual offense, felony, offense involving violence, abuse, neglect, fraud, larceny, a minor and/or the safety of others.
   

7. You are not currently required to register as a sex offender with any governmental entity.
   

(Collectively, the “Eligibility Certifications”).

You certify that the Eligibility Certifications are true and correct and that Gobeyondteaching.com may rely thereon. 

You agree that Gobeyondteaching.com may change the Eligibility Certifications and/or require new certifications in its sole discretion at any time. 

You understand and acknowledge and agree that Gobeyondteaching.com has no actual knowledge of the Eligibility Certifications and that Gobeyondteaching.com does not independently verify or otherwise investigate the Eligibility Certifications. 

You agree to contact Gobeyondteaching.com immediately if you have reason to believe or are aware that a Service Seeker or Service Provider does not meet the Eligibility Certifications by electronic transmission to support@gobeyondteaching.com.

In the event Gobeyondteaching.com becomes aware, that you may not meet or do not meet any condition of eligibility, Gobeyondteaching.com may terminate you from further use of the Site without notice and/or refund.  Upon termination, you agree to make no further use of the Site. 

Gobeyondteaching.com reserves the right, but is under no obligation, to take legal action in the event of a breach of this Agreement or any of the Terms or Conditions herein, including, but not limited to a failure to meet the eligibility requirements. 

Teacher Certifications

In addition to the Eligibility Certifications, each Service Provider certifies, represents and warrants that they meet and will continue to meet one of the following conditions for so long as they access use and/or subscribe to the Site:

1. You are currently teaching in a classroom and hold a valid teaching certificate.
   

2. You are not currently teaching in a classroom and hold a valid teaching certificate and were not terminated for cause from a teaching position and are not under investigation in relation to a potential termination from a teaching position.
   

3. You are a student of education working towards a teaching certificate and/or masters degree in education and are currently enrolled in such a program.
   

4. You are a retired teacher and hold a valid teaching certificate and were not terminated for cause from a teaching position and are not under investigation in relation to a termination from a teaching position.
5. You are a college instructor working in a valid college or university.  
   

(Collectively the “Teacher Certifications”).

You certify that the foregoing are true and correct and that Gobeyondteaching.com may rely thereon. 

You agree that Gobeyondteaching.com may change the Teacher Certifications and/or require new certifications in its sole discretion at any time. 

You understand, acknowledge and agree that Gobeyondteaching.com has no actual knowledge of the Teacher Certifications and that Gobeyondteaching.com does not independently verify or otherwise investigate the Teacher Certifications. 

You agree to contact Gobeyondteaching.com immediately if you have reason to believe or are aware that a Service Provider does not meet any of the Teacher Certifications by electronic transmission to support@gobeyondteaching.com.

In the event Gobeyondteaching.com becomes aware that you may not meet or do not meet any condition of eligibility, Gobeyondteaching.com may terminate you from further use of the Site without notice.  Upon termination, you agree to make no further use of the Site. 

Gobeyondteaching.com reserves the right, but is under no obligation, to take legal action in the event of a breach of this Agreement or any of the Terms or Conditions herein, including, but not limited to, a failure to meet the eligibility requirements.

Responsible For Independent Investigation

You agree that you make your own investigation and decisions regarding the suitability of any job posted by a Service Seeker or any services offered by a Service Provider.  You understand and agree that Gobeyondteaching.com has no responsibility to and does not independently investigate or verify any of the information submitted to it or placed on the Site, including, but not limited to, the Eligibility Certifications, the Teacher Certifications and any other information transmitted to or through the Site by a Site User. 

Exclusive Use

You agree not to transfer, resell or assign your rights or obligations under this Agreement. If you suspect that there has been unauthorized use of your account, you agree to immediately contact Gobeyondteaching.com via electronic transmission to support@gobeyondteaching.com.

Compliance with Children’s Online Privacy Protection Act

Gobeyondteaching.com is intended for use by people 18 or older.  Gobeyondteaching.com is designed to appeal to persons over the age of 18. You must indicate your age when you register with the Site,   The Site and its policies and procedures are designed to comply with the Children’s Online Privacy Protection Act of 1998 (“COPPA”) as well as Federal Trade Commission Regulations.

You agree to notify Gobeyondteaching.com immediately by electronic transmission at support@gobeyondteaching.com of any Site User you know or have reason to believe is under the age of 18.

Gobeyondteaching.com does not assume any responsibility or liability for misrepresentations regarding age by Site Users.

Truthfulness and Accuracy of Information

You are solely responsible for providing truthful, accurate, lawful and complete information in connection with your use of this Site and in your communications and interactions with Site Users. Gobeyondteaching.com is solely a communications platform and is not involved in communications or transactions between or among Site Users. You are solely responsible for any information that you post on the Site or communicate to a Site User.

You represent and warrant that the information and material which you post on or upload to the Site (“Public Information”), communicate or provide to other Site Users and/or provide to Gobeyondteaching.com:

1. Is owned by you.
2. Is true, accurate. lawful and not misleading.
3. Is not fraudulent.
4. Does not infringe any proprietary right.
5. Does not infringe or violate any, right of publicity or privacy.
6. Does not violate any laws or regulations.
7. Is not defamatory or libelous.
8. Is not threatening or harassing.
9. Is not racially offensive, sexually offensive, or ethnically offensive.
10. Is not obscene, inappropriate, offensive, or sexually oriented.
11. Is not and does not contain child pornography.
12. Is not harmful to children or designed or intended to be harmful to children.
13. Does not contain any viruses or the like, that may damage, interfere with, intercept or expropriate data or personal information.
14. Will not create liability for gobeyondteaching.com, its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives.
15. Does not breach a contract.

Grant of Interest in Your Information

You hereby grant Gobeyondteaching.com, its parent, affiliates, subsidiaries, partners and licensees a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to exercise any and all proprietary rights which you have or may have in the your Public Information, including, but not limited to, the right to use, copy, display, reproduce, adapt, and distribute such information. Gobeyondteaching.com will use your information in accordance with its Privacy Policy.

It is your responsibility to monitor your account and maintain the confidentiality of the password which you have created for your account.  You are also responsible for all activity which occurs with respect to your account. You agree to contact Gobeyondteaching.com immediately if you suspect that there has been unauthorized activity in your account.

Non-Solicitation

The Site may be used by you to connect with Service Providers or Service Seekers, as the case may be.  You represent, warrant and agree that you will not recruit, solicit, advertise, sell to and/or contact Site Users for employment, advertising and/or contracting for a business which is not contemplated by and in accordance with this Agreement and affiliated with Gobeyondteaching.com or otherwise using or disseminating information on the Site or transmitted in connection with the Site. 

In the event of a violation of this provision, Gobeyondteaching.com has the right to terminate your use of the Site at its sole discretion and without notice, assess a $5,000.00 penalty against you and/or pursue any and all other legal and/or equitable remedies which it may have against you.

Prohibition Against Commercial Use

The Site is a communications platform for use by individuals to connect with Service Seekers and Service Providers.  The Site is not to be used for commercial purposes including, but not limited to, the collection of names or email addresses of Site Users.

In the event of a violation of this provision, Gobeyondteaching.com has the right to terminate your use of the Site at its sole discretion, without notice, assess a $5,000.00 penalty against you and/or pursue any and all other legal and/or equitable remedies which it may have against you.

Links to other sites on the Web are made available on the Site (“Linked Sites”). You understand and agree that these Linked Sites are provided for informational purposes only and that Gobeyondteaching.com does not endorse any of these Linked Sites or have any control over them or their content.  You understand and agree that the Linked Sites are governed by their own terms and conditions and privacy policies and not those of Gobeyondteaching.com. It is your responsibility to read and understand the terms of use and privacy policies of the Linked Sites before using the Linked Sites. 

You understand and agree that use of any Linked Site is at your own risk.  Gobeyondteaching.com its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives disclaim any liability for any damages, losses or expenses arising out of or relating to the Linked Sites, including, but not limited to, damages You agree to hold Gobeyondteaching.com, its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives harmless from any liability that may result or arise from use of the links to the Linked Sites.

Billing, Payment, Automatic Renewal and Refund Policy For Service Seekers

Service Seekers are responsible for paying for use of the Site in accordance with the rates and terms set forth on the Site at the time of registration at the Site (the “Subscription”).  Service Seekers agree to pay all charges associated with use of the Site in accordance with the Subscription and authorize Gobeyondteaching.com to charge their chosen payment provider for the charges associated with the Subscription. Rates and terms may change at anytime in the sole discretion of Gobeyondteaching.com.  A change in rates and terms will not change the rate or term of an existing Subscription.    

A Service Seeker is obligated to pay the cost of a Subscription unless they have terminated the Subscription prior to commencement of the initial Subscription period.

Any request for cancellation of a Subscription shall be transmitted electronically to support@gobeyondteaching.com.  There will be no refunds or credits to Service Seekers for cancellation requests made after a charge for a Subscription has been billed.

Gobeyondteaching.com used reasonable efforts to protect the privacy of your payment information and any personal information which is transmitted to it and is not Public Information.  Please see the Privacy Policy of Gobeyondteaching.com for further information on the privacy policies of Gobeyondteaching.com. Gobeyondteaching.com disclaims any liability for damages that may result in the event personal information is released to and or misappropriated by third parties, including, but not limited to payment information.  You agree to hold Gobeyondteaching.com, its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives harmless for any damages that may result from a release to or misappropriation of information by third parties.

Reinstatement After Cancellation or Lapse

In the event a Subscription lapses or is cancelled you are required to re-register at the Site. Any new subscription and any renewal period thereafter will be for the rate and term as set forth on the Site at that time and you re-register.

No Warranties and Disclaimers as to Site Service  

Gobeyondteaching.com makes no warranties, either express or implied, or guarantees of any kind whatsoever with respect to the Site.  Gobeyondteaching.com does not warrant or guarantee that use of the Site will be uninterrupted or that the Site will be error-free or that the Site will meet your needs or be suitable for your requirements or that defects in the Site will be corrected. Gobeyondteaching.com does not warrant or guarantee that personal information transmitted to it will not be intercepted, misappropriated and/or used by third parties or that the Site is free of viruses and the like.

Without limiting the foregoing, Gobeyondteaching.com is always working to improve the Site and makes reasonable efforts to correct Site issues of which it is actually aware.

You agree to immediately notify Gobeyondteaching.com of any Site issues by electronic transmission to support@gobeyondteaching.com.

Gobeyondteaching.com its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives disclaim any liability for any damages, losses or expenses arising out of or relating to the misappropriation and/or use of personal information transmitted to it or the inability to use the Site, including, but not limited to, damages related to inability to access the Site, failure of the Site to perform, any errors, omissions, interruptions and/or defects in the Site, delayed operation or transmission of information on or to the Site, transmission of computer viruses, and, the like, or line or system failure.

Without limitation to the foregoing, in no event, will the aggregate liability of gobeyondteaching.com, its parent, affiliates, subsidiaries, members, officers, directors, agents, employees, assigns and representatives exceed the total amount paid by any Site Users for membership in the Site for a one year period under this Agreement. 

Termination of Access to Site and Services

Gobeyondteaching may, in its sole discretion, terminate access to all or part of the Site by any Site Users and/or, terminate a Subscription due to a breach of this Agreement and/or  remove any information and/or content from the Site with or without cause. Upon termination from the Site Gobeyondteaching.com may transmit notice thereof to other Site Users. 

In the event a Subscription is terminated due to a breach of this Agreement, any refund for unused subscription fees is hereby waived by you.

Upon termination from the Site you agree to cease all access to and use of the Site.

Survival

This Agreement shall survive termination from the Site, termination of a Subscription and/or Renewal Period, lapse in a Subscription and/or Renewal Period and/or cancellation of a Subscription and/or Renewal Period.

Intellectual Property

All content, including text, graphics, data, designs, photographs, sounds images, designs visible on the Site (collectively, “Proprietary Material”) is owned by Gobeyondteaching.com or used with the permission of the owner.  The Proprietary Material is protected in all forms.  Site Users may not copy, download or otherwise use or alter anything from the Site without the written permission of Gobeyondteaching.com. Site Users are not allowed to post or transmit any material which they do not own or have permission to use.  Violation of any of the foregoing, may result in liability, criminal and or civil penalties and/or termination from the Site. If you believe that any information or content on the Site infringes a proprietary right, please notify Gobeyondteaching.com via electronic transmission at support@gobeyondteaching.com.

Trademark Rights

Gobeyondteaching.com and its logo are registered service marks, trademarks and logos owned by Gobeyondteaching.com.  Site Users acknowledge the rights and ownership thereof.  Site Users may not copy or use these marks, trademarks or logos without the prior written permission of Gobeyondteaching.com. 

Other trademarks, service marks, logos and/or tradenames appearing on the Site are the property of their respective owners.  Site Users acknowledge the rights and ownership thereof.  Site Users may not copy or use these marks, trademarks or logos without the prior written permission of the owner thereof.

Copyright Notice

All content of the Site is protected by copyright.  You may only use the information contained on the Site for personal use and may not reproduce, adapt or publish it, in whole or in part, without the express written permission of Gobeyondteaching.com.

Limited License to Site Users

Site Users are granted a nonexclusive, revocable right to use the Site provided that they do not violate any of the Terms and Conditions.

Site Modifications and/or Discontinuation

Gobeyondteaching.com may in its sole discretion modify and/or discontinue, temporarily or permanently, the Site without notice to Site Users. 

Agreement Subject to Arbitration

You agree that any dispute arising out of or relating to this Agreement, the Terms and Conditions, and/ or the Site shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association and before a single arbitrator.  The arbitration shall be conducted in Fairfield County, Connecticut. 

Choice of Law and Venue

You agree that this agreement shall be governed by and construed in accordance with the laws of the State of Connecticut without regards to its conflict of law provisions.

You agree that exclusive jurisdiction resides in the courts in Fairfield County, Connecticut to the extent that the arbitration provision does not control.

Entire Agreement

This Agreement constitutes the entire Agreement between you and Gobeyondteaching.com.

Severability

In the event that any one or more of the provisions of this Agreement is held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not in any way be affected or impaired thereby.

Binding on Successors and Assigns

This Agreement shall be binding on and inure to the benefit of the legal representatives, successors and assigns of the parties hereto.
